1. About this policy

Psycle Group Pty Ltd (ABN 47 679 688 932), trading as Psycle Wellness ("Psycle", "we", "us" or "our"), is committed to protecting your privacy and handling your personal information openly and transparently.

This Privacy Policy explains how we collect, hold, use, disclose and protect personal information, and how you can access or correct that information or make a complaint. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy applies to our website at thepsycle.com, to any of our other digital channels, and to all dealings we have with you over the phone, by email, in person or through our sales and customer service processes.

By providing us with your personal information or using our website, you agree to your information being handled as set out in this policy.

2. What is personal information

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in a material form or not. Examples include your name, contact details, delivery address and order history.

3. The personal information we collect

The kinds of personal information we collect and hold depend on how you interact with us. They may include:

  • Identity and contact details, such as your name, email address, phone number, billing address and delivery address.
  • Delivery and installation details, including your property postcode and site access information needed to quote and arrange freight and delivery.
  • Order and transaction information, such as the products you enquire about or purchase, deposit and balance payments, invoice numbers and order history.
  • Payment information. Card payments are processed by our third-party payment providers. We do not store full card numbers on our own systems.
  • Communications and enquiry records, including emails, web form submissions, live chat messages, and notes and recordings of phone calls with our sales and customer service team.
  • Marketing preferences, including whether you have subscribed to or opted out of our email or SMS communications.
  • Technical and usage information collected automatically when you visit our website, such as your IP address, device and browser type, pages viewed and cookie data (see section 10).

We generally do not collect sensitive information (see section 6).

4. How we collect personal information

Wherever it is reasonable and practicable, we collect personal information directly from you. We may collect it when you:

  • make an enquiry or request a quote through our website, by email, by phone or in person.
  • place an order, pay a deposit or balance, or otherwise transact with us.
  • subscribe to our newsletter, promotions or SMS updates.
  • communicate with our customer service team, including by live chat.
  • interact with our website, social media pages or advertising.

In some cases we may collect personal information from third parties, for example our logistics partner, payment providers, or referrals, where it is reasonable to do so and connected to one of the purposes below. If we receive personal information about you that we did not request and could not lawfully have collected, we will deal with it in accordance with the APPs.

5. Why we collect, hold, use and disclose your personal information

We collect, hold, use and disclose personal information for the following purposes:

  • to respond to your enquiries and provide quotes and product information.
  • to process and fulfil your orders, including taking payment, arranging manufacturing where applicable, and coordinating freight, delivery and after-sales support.
  • to communicate with you about your order, account or enquiry.
  • to provide customer service, warranty support and to handle returns or complaints.
  • to send you marketing communications about our products and offers, where you have not opted out (see section 9).
  • to operate, maintain, improve and personalise our website and services.
  • to maintain our business records and manage our relationship with you.
  • to comply with our legal and regulatory obligations.

If you do not provide the personal information we request, we may not be able to respond to your enquiry, process your order, arrange delivery or provide the service you have asked for.

6. Sensitive information

Sensitive information includes information about your health, racial or ethnic origin, political opinions, religious beliefs and similar categories, and is given a higher level of protection under the Privacy Act.

We do not generally seek to collect sensitive information. We will only collect sensitive information where you consent and the information is reasonably necessary for one of our functions or activities, or where the collection is otherwise permitted or required by law.

7. Who we disclose your personal information to

We do not sell your personal information. We may disclose your personal information to:

  • our directors and authorised personnel who need it to perform their role.
  • our service providers and partners who help us run our business, including:
    • our e-commerce and website platform provider.
    • our payment processors.
    • our customer relationship management (CRM) and email and SMS marketing platforms.
    • our website analytics and advertising providers.
    • our freight, logistics and fulfilment partner, to arrange delivery.
    • our accountants, auditors and professional advisers.
  • government bodies, regulators, law enforcement or courts where we are required or authorised by law to do so.
  • a purchaser or potential purchaser of our business or assets, in connection with a sale or restructure.

We only disclose personal information for the purposes for which it was collected, for a related secondary purpose you would reasonably expect, or as otherwise permitted by law. Where we engage service providers, we take reasonable steps to ensure they handle your personal information consistently with this policy and the APPs.

8. Disclosure of information overseas

Some of the service providers we use to run our business store or process personal information outside Australia. This is common for businesses that use modern e-commerce, payment, customer relationship management and marketing platforms, as many of these providers operate global cloud infrastructure.

Based on our current providers, your personal information is likely to be disclosed to, stored in or accessed from the following countries:

  • the United States, where our payment processors, customer relationship management platform, email and SMS marketing platform, and website analytics and advertising providers are based or host data, and where our e-commerce platform's hosting infrastructure is located.
  • Canada, where our e-commerce platform provider is headquartered.
  • Singapore, where some of our providers and their subprocessors may store or process data.

Because several of these providers use global cloud service providers and subprocessors, your personal information may also be processed in other countries in which those providers operate. It is not always practicable for us to identify every such country in advance.

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the Australian Privacy Principles, or we otherwise rely on an exception permitted under the Privacy Act. We also seek to engage reputable providers who maintain appropriate data protection and security standards.

9. Direct marketing and how to opt out

We may use your personal information to send you marketing communications about our products, news and offers by email, SMS or other channels, where the law permits and you have not opted out.

You can opt out of marketing communications at any time by:

  • using the unsubscribe link in any of our marketing emails.
  • replying with the opt-out instruction in any SMS.
  • contacting us using the details in section 18.

We will action your request within a reasonable time. Even after you opt out of marketing, we may still contact you about your specific orders, enquiries or other operational matters. We handle electronic marketing in accordance with the Spam Act 2003 (Cth).

10. Cookies and website analytics

Our website uses cookies and similar technologies to help it function, to remember your preferences, to measure website performance and to support our marketing.

Cookies are small text files placed on your device. Some are essential for the website to work, while others help us understand how visitors use our site and allow us and our advertising partners to deliver more relevant advertising.

You can set your browser to refuse some or all cookies, or to alert you when cookies are being used. If you disable cookies, some parts of our website may not work properly. We may use third-party analytics and advertising tools that collect information about your use of our website and other websites over time.

11. How we store and protect your information

We hold personal information in electronic systems operated by us and our service providers, and in some cases in physical records.

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, use of reputable service providers, and staff handling practices.

No method of transmission over the internet or electronic storage is completely secure, so while we strive to protect your personal information we cannot guarantee absolute security.

12. How long we keep your information

We keep personal information only for as long as it is needed for the purposes set out in this policy, or for as long as we are required to keep it to meet legal, accounting, tax or regulatory obligations.

When personal information is no longer required and we are not required by law to retain it, we take reasonable steps to destroy it or to permanently de-identify it.

13. Automated decision-making

We do not currently use automated systems to make decisions that have a legal or similarly significant effect on you without human involvement. If this changes, we will update this policy and provide the information required under the Privacy Act.

14. Accessing and correcting your information

You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, contact us using the details in section 18. We may need to verify your identity before we provide access. We will respond within a reasonable time.

In most cases there is no charge for making a request, although we may charge a reasonable fee for giving access in some circumstances. If we refuse access or a correction, we will tell you why in writing and explain how you can complain.

15. Notifiable data breaches

We have procedures in place to respond to data breaches. If a data breach occurs that is likely to result in serious harm to any individual whose personal information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

16. Children's privacy

Our products and website are intended for adults. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us and we will take reasonable steps to delete it.

17. Third-party websites

Our website may contain links to third-party websites and services. We are not responsible for the privacy practices or content of those sites. We encourage you to read the privacy policies of any third-party websites you visit.
